UK Raises Minimum Age for Vaping to 18

The UK tobacco, vape, and next-generation nicotine market is undergoing significant legislative changes that will reshape retail operations. Starting 29 October, the minimum age for purchasing all vaping and nicotine products, including zero-nicotine e-liquids and nicotine pouches, will rise to 18. Adults aged 18 or older will be barred from buying these products on behalf of anyone under 18. Additionally, free giveaways and samples will be banned, and substantial discounts will face restrictions. A separate “Generational Smoking Ban” will take effect on 1 January 2027, making it illegal to sell tobacco to anyone born on or after 1 January 2009 under the Tobacco and Vapes Act.
Market Trends and Consumer Behavior
Alongside regulatory shifts, the market is splitting into distinct segments. Andrew Malm, UK Market Manager for Imperial Brands, notes a two-tier pricing structure driven by economic pressures. Economy and value cigarette brands account for 72.6% of sales, while premium products hold just over 10%. However, they have risen to 37% of the market from 36% the previous year, showing resilience among loyal consumers willing to pay more for trusted brands.
In vaping, Angelo Yang of ELFBAR and LOST MARY highlights prefilled pod kits as dominant, with high puff count formats representing over 60% of the market. Smaller devices remain popular for lower upfront costs. Rising cigarette prices and cost-of-living pressures favor them due to their larger e-liquid capacity and lower cost per puff. Refills are gaining traction as a cost-effective alternative to device replacement.
Vape use has surpassed smoking in Great Britain, with cigarette use at an all-time low. An ELFBAR survey found 55% of current regular smokers tried vaping to quit, compared to 21% using nicotine patches and 20% using nicotine gum. Vaping’s role in driving retail footfall and revenue is evident from the ELFBAR survey findings.
Growth in Nicotine Pouches
Nicotine pouches represent a key growth area. Kilic emphasizes their convenience and discretion, noting strong demand for lower and medium nicotine strengths. The global market is projected to grow from £4 billion in 2025 to £11 billion by 2030, with 47 million users worldwide. In the UK, VELO has driven category growth, aided by consumer interest in smokeless alternatives. Sweden nears being the first European smoke-free country, largely due to them.
Adam Palmer of STG UK states the pouch market is becoming competitive, with two major players accounting for 80% of sales. New brands, flavors, and strengths are expanding the category, though mint flavors and higher strengths remain popular. Female usage has grown significantly, and poly-nicotine users are increasingly switching between pouches, vapes, and tobacco based on occasion.
Innovation continues in next-generation nicotine products. Palmer notes XQS nicotine pouch portfolio expanded with a new mint range, while 8mg SKUs transition to 10mg to meet demand for medium to higher strengths. Yang highlights refills as a growing opportunity in prefilled pods, with 79% of users purchasing separate refills rather than new kits, according to an ELFBAR Opinium survey from August 2026.
Palmer predicts traditional tobacco sales will decline steadily, while nicotine pouches maintain growth, especially with upcoming vape duties creating price parity. Kilic stresses that innovation and diverse portfolios are essential for attracting and retaining users.
Future Outlook and Market Evolution
Palmer highlights that upcoming vape duties will create price parity between categories, accelerating this shift. Kilic emphasizes the importance of diverse portfolios to meet varied consumer preferences.
Retail Strategies for Regulatory Compliance
Retailers must adapt to new regulations, beginning with age verification protocols. Yang advises reviewing promotional practices and staff training to ensure compliance with sample and discount bans.
Stock management will require careful planning, especially regarding duty stamps. Unmarked products can be sold until 31 March 2027, but new duty-liable items must display required markings from 1 October 2026. Kilic stresses partnering with reliable suppliers who provide compliance documentation and traceability.
The Generational Smoking Ban will further restrict sales to those born after 2009. Kilic notes that reconfiguring displays and storage areas will be necessary to accommodate these changes. Retailers must also prepare for the “Decline ’09” campaign and Challenge 25 policy enforcement, which will intensify checks in 2027.
